This Privacy Policy describes how SwapLab ("the App", "we", "us", or "our"), developed by Emre Akbas, collects, uses, discloses, and protects information about users of the SwapLab – Deep Fake mobile application. By using SwapLab, you acknowledge that you have read and understood this Privacy Policy.
Plain-Language Summary: SwapLab uses two third-party AI services — fal.ai and Replicate — to generate face-swap images. When you create an image, the photos and prompts you provide are transmitted to one of these services for processing. We ask for your explicit consent before any data is sent. We do not store your photos, face data, or generated images on our own servers.
1. Information We Collect
1.1 Information You Provide
- Photos and Images: Photos you upload or capture within the App for the purpose of face-swap or image generation, including images containing facial features ("Face Data").
- Text Prompts: Any text descriptions or instructions you enter to guide image generation.
- Purchase Information: Subscription and in-app purchase information is handled entirely by Apple. We do not collect or store payment card details.
1.2 Automatically Collected Information
- Device information (model, operating system version, language preference)
- App usage analytics (features used, crash reports) — anonymized
- IP address and approximate location (country level only)
2. How We Use Your Information
We use the information collected to:
- Provide the core face-swap and image generation functionality of the App
- Transmit your photos and prompts to third-party AI services for processing — only after you have given explicit consent
- Return generated images back to your device
- Improve App stability and fix bugs through anonymized analytics
- Process subscriptions and respond to support requests you send us
3. Third-Party AI Services — Data Sharing Disclosure
Important: SwapLab cannot generate face-swap images without sending your photos to a third-party AI service. The App will explicitly ask for your permission the first time you use this feature, and you may revoke this permission at any time in the App's Settings.
3.1 Who We Share Data With
To generate images, SwapLab transmits user-provided content to the following third-party AI processors:
3.2 What Data Is Sent
When you generate an image, the following data is sent to either fal.ai or Replicate (depending on the model you select):
- The photos/images you have selected for face-swap or generation
- Face Data extracted from those photos (facial features required to perform the swap)
- The text prompt you entered, if any
- Technical parameters required by the AI model (e.g., output resolution, style settings)
We do not send your name, email address, contact list, device identifiers tied to your identity, precise location, or any other personal information to these AI services.
3.3 How Data Is Handled by These Services
Both fal.ai and Replicate process the submitted content solely to return a generated image. According to their respective privacy policies:
- Submitted images and prompts are processed transiently to fulfill the generation request.
- These providers contractually commit to industry-standard security measures, including encryption in transit (HTTPS/TLS).
- We have reviewed their privacy policies and confirm that they provide protections equivalent to those described in this Policy for the purpose of providing the requested service.

3.4 Your Consent
Before any data is sent to fal.ai or Replicate, SwapLab displays an in-app consent screen that:
- Identifies the specific third-party AI service that will receive your data
- Describes exactly what data will be sent (photos, face data, prompts)
- Requires you to tap "I Agree" before proceeding
If you decline, no data is transmitted and the generation feature is not available. You may revoke consent at any time from Settings → Privacy → AI Processing Consent, after which no further data will be sent.
4. Face Data — Specific Protections
Because SwapLab processes facial imagery, we apply additional safeguards:
- No on-server storage: SwapLab does not store your photos or extracted Face Data on any server operated by us.
- Transient transmission only: Photos and Face Data are sent directly from your device to the AI service over an encrypted connection (HTTPS/TLS).
- No use for training: We do not use your photos, Face Data, or generated images to train AI models, and we have configured our integrations with fal.ai and Replicate to prevent your content from being used for their model training where such options are available.
- No third-party sharing beyond processing: Face Data is never shared with advertisers, data brokers, or any party other than the AI processor selected to fulfill your generation request.
5. Data Retention
- On your device: Generated images remain on your device until you delete them.
- On our servers: We do not retain your photos, Face Data, or generated images.
- At AI processors: Retention is governed by fal.ai's and Replicate's policies (typically short-term operational logs). Please consult their privacy policies for specifics.
- Analytics: Anonymized usage analytics are retained for up to 24 months.
6. Data Security
We use industry-standard security measures, including TLS encryption for all data in transit. While we strive to protect your information, no method of electronic transmission or storage is 100% secure.
7. Your Rights
Depending on your jurisdiction (including under GDPR and CCPA), you may have the right to:
- Access the personal data we hold about you
- Request correction or deletion of your data
- Withdraw consent for third-party AI processing (via in-app Settings)
- Object to or restrict certain processing
- Lodge a complaint with your local data protection authority

8. Children's Privacy
SwapLab is not intended for users under the age of 13 (or the equivalent minimum age in your jurisdiction). We do not knowingly collect personal data from children. If you believe a child has provided us with personal data, please contact us so we can delete it.
9. User Responsibility for Uploaded Content
You are solely responsible for the photos and content you upload to SwapLab. By uploading content, you confirm that you own it or have obtained all necessary permissions from any individuals depicted. You agree not to upload images of other people without their consent, and you agree to indemnify SwapLab against any claims arising from content you upload.
10. Links to Third-Party Sites
SwapLab may contain links to third-party websites. This Privacy Policy does not apply to those sites. We encourage you to review their privacy policies before providing personal data.
11. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. Material changes will be communicated through the App or via email where applicable. The "Last Updated" date at the top reflects the latest revision. Continued use of the App after changes constitutes acceptance of the revised Policy.
